While there is no single or specific Dependent visa in the UK, there are several options depending on the visa status of the main visa holder.

These visas aim to enable families to stay together while one member works, studies, or resides in the UK under visa categories such as work visas.

1. Main Types of Dependent Visas

A UK Dependant Visa allows the family members (partners, children) of certain visa holders to join them in the UK. The eligibility for dependants depends on the visa category of the main visa holder, such as a Skilled Worker, Student, or someone with Indefinite Leave to Remain (ILR).

a. PBS Dependant Visas

The UK Points-Based System (PBS) Dependant Visa allows family members (spouses, partners, and children) of certain visa holders, such as Skilled Worker, Innovator Founder, Global Business Mobility or Global Talent migrants, to join them in the UK.

Dependent eligibility criteria can vary depending on the main visa holder’s category. For example, the Health and Care Worker visa permits visa holders to be accompanied by dependants, except for visa holders in care worker and senior care worker roles.

Eligible dependants can live, work (with some restrictions), and study in the UK, but cannot access public funds. Each dependant must apply separately and provide proof of relationship, financial stability, and valid biometric information. The visa duration usually aligns with the main visa holder’s.

After five years in the UK, dependants may be eligible to apply for Indefinite Leave to Remain (ILR) if other requirements are met.

b. Student Visa Dependants

The dependants of those on a student visa studying a postgraduate course (lasting more than 9 months) at a UK university can also join them.

The same privileges apply, allowing dependants to work and study but without access to public funds.

The ability for all student visa holders to be joined by dependants was removed for applications made after 1 January 2024.

c. Adult Dependant Relative (ADR) Visa

This visa is for close adult family members, typically elderly parents or grandparents, who need long-term care that can only be provided by family members in the UK .

2. Who Qualifies as a Dependant?

The eligibility for a Dependent Visa extends to various family members of the primary visa holder, including:

a. Spouse or Civil Partner: The legal spouse or civil partner of the primary visa holder is eligible for a Dependent Visa. Proof of a genuine and subsisting relationship is required.

b. Unmarried Partner: An unmarried partner can also qualify if they have been in a relationship akin to marriage or civil partnership for at least two years prior to the application.

c. Children: Dependent children under the age of 18 can accompany the primary visa holder. Children over 18 may also qualify if they were granted leave as dependents when they were under 18 and continue to be financially dependent on the primary visa holder.

d. Parents: In some cases, particularly for adult dependent relatives, parents can qualify if they need long-term care that cannot be provided in their home country.

Each of these dependents must meet specific criteria relating to the main applicant’s visa category and provide relevant documentation to prove their eligibility.

1. Main Applicant Visa Status

The primary criterion for a Dependent Visa is the visa status of the main applicant:

Visa holders under most work visas, some student visa holders and those with long-term visas such as the Innovator Founder, Global Talent visa and Ancestry categories may be able to bring dependants with them to the UK.

The dependant’s eligibility is directly tied to the visa status of the main applicant, and the validity of the dependent visa is usually linked to the duration of the main applicant’s visa.

2. Relationship Proof Requirements

To qualify for a Dependent Visa, the applicant must provide proof of their relationship with the main visa holder. This includes:

a. Spouse or Civil Partner: A marriage certificate or civil partnership certificate.

b. Unmarried Partner: Evidence of cohabitation for at least two years, such as joint tenancy agreements, shared bank accounts, or utility bills in both names.

c. Children: Birth certificates showing the relationship to the main visa holder. For children over 16, additional proof of financial dependency and a shared household may be required.

d. Other Dependents: For parents or other adult relatives, proof of dependency and the necessity of long-term care that cannot be provided in the home country.

3. Financial Maintenance Requirements

In most cases, evidence will need to be provided that the main applicant can support their dependants without assistance or support from public funds.

The financial requirements vary based on the visa category of the main applicant. For example:

a. Skilled Worker Visa Holders must show a specific amount of savings to support each dependent for a minimum period, usually 28 days before the application.

The main applicant will need to show £285 in savings for their dependent partner, as well as £315 for the first dependent child and £200 for each additional dependent child.

This requirement will not apply if the worker’s sponsor holds an A-rated licence and certifies on the Certificate of Sponsorship that they will cover these funds on the worker’s behalf.

b. Student Visa Holders need to prove they have enough money to cover living costs for each dependant, in addition to their own maintenance funds.

The amount required depends on where you will be studying. For courses in London, they will need £845 per month for up to 9 months. For courses outside London, the requirement is £680 per month for the same duration. If you are applying together as a family, you will need to demonstrate that you have enough money for your course, your own living costs, and additional funds for each dependant. However, if your partner or child applies at a different time to you, they will only need to show they have sufficient money to support themselves.

This money must be held for at least 28 consecutive days, and the final day of this period should be within 31 days of the visa application. If you are supported by a student loan or financial sponsorship, you will need to provide evidence from the relevant institution. However, if the loan does not cover your dependants, you must prove you have the necessary funds for them separately.

There are exceptions to this requirement. If your partner or child has been living in the UK with a valid visa for at least 12 months, they are not required to demonstrate they have these funds.

4. Other Specific Eligibility Conditions

In addition to the primary criteria, there are other specific conditions that dependents must meet:

a. Age Requirements: Dependent children must be under 18 at the time of application, unless they were previously granted a dependent visa and are now over 18 but still financially dependent.

b. Health and Character Requirements: Dependants will need to undergo tuberculosis (TB) testing if they are from certain countries and provide a clean criminal record certificate if required.

c. Intent to Live Together: The dependant and the main visa holder must intend to live together in the UK throughout the duration of their stay.

For children, a birth certificate that includes the names of both parents must be provided, and in the case of adoption, legal adoption papers are required. If a child is living with only one parent, additional evidence of sole responsibility may also be needed.

Financial evidence must be submitted to prove that there are sufficient funds to support the dependants. This can include recent bank statements and, if the main applicant is employed, salary slips to show regular income. If financial support is being provided by a sponsor, their financial documents should also be included.

Regarding accommodation, the applicant must provide a copy of the tenancy agreement for rented accommodation, or, if the property is owned, proof of ownership such as mortgage statements or property deeds.

If the applicant is from a country where TB testing is mandatory, a valid TB test certificate must be included with the application.

In some cases, proof of English proficiency may be required. This can be demonstrated through passing an approved English language test or submitting certificates from institutions where the medium of instruction was English.

The visa application form must be accurately filled out, based on the type of dependant visa being applied for. Additional supporting documents, such as a police clearance certificate, may be required to show a clear criminal record. If the applicant has any health conditions, relevant medical reports should be submitted. Step 3: Complete the Online Application Form

Visit the official UK government visa application website. Select the appropriate visa type and fill out the online application form. Ensure that all information is accurate and matches the details in your supporting documents.

Dependants will be asked to provide the main visa applicant’s application number. This will either be a Global Web Form (GWF) or a Unique Application Number (UAN), which can be found in Home Office communications to the main applicant.

They may also be asked to provide the family linking code, if this was provided to the main applicant. This will connect all of the family’s applications.

Step 4: Pay the Visa Fee

The visa fee varies based on the type of dependent visa and the length of stay. In most cases, the fee will be the same as for the main visa application, although exceptions apply, such as the Global Talent route.

Pay the visa fee online using a credit or debit card. Keep the payment receipt as proof of payment.

Step 5: Verify Identity

After completing the online application and paying the fee, dependants will have to verify their identities, either by using the UK Immigration: ID Check’ app or booking an appointment at a local visa application centre to submit their biometric information (fingerprints and photograph). You will be advised when you apply which options you can use.

Step 6: Submit Supporting Documents

Depending on the specific requirements, you may need to submit your supporting documents in person at the visa application centre or upload them online. Follow the instructions provided during your online application.

Step 7: Wait for a Decision

After submitting your application and documents, you will need to wait for a decision. The processing time can vary, so check the typical processing times on the UK government website.

You can receive updates via email or SMS about the status of your application, or log in to check your application’s progress.

Step 8: Receive Your Visa Decision

You will be notified of the decision by email. If approved, you will be given instructions for the next steps and instructions on how to access your visa online.

How to Prove Your Relationship to the Home Office

When applying for a visa on the basis of your relationship to a British national or a person who has settled permanently in the UK, you will need to satisfy UK Visas and Immigration (UKVI) that your relationship is genuine and subsisting (i.e. you are still together). This is entirely understandable, as there have been past cases of applicants seeking a spouse or fiancé /fiancée visa under the family migration route who have not been entirely honest about their relationship. In some of these cases, the supposed relationship didn’t exist at all – these are so-called ‘ sham ’ relationships or marriages. It is even possible for the UKVI to wrongfully refuse applications for genuine cases whereby they have reason to suspect that the relationship is a sham. In this article, we will explain how to prove your relationship to the Home Office.

What do I need to show as proof when applying for a spouse or partner visa?

When applying for a spouse or partner visa, you will need to satisfy the Home Office that you:

  • are in a civil partnership or marriage that’s recognised in the UK
  • Have been living together in a relationship for at least two years when you apply
  • You are a fiancé, fiancée or proposed civil partner and will marry or enter into a civil partnership in the UK within six months of arriving

Your partner must:

  • be a British or Irish citizen, or;
  • have settled in the UK - for example, they have indefinite leave to remain , settled status or proof of permanent residence, or;
  • be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status - they must have started living in the UK before 1 January 2021, or;
  • have a Turkish Businessperson visa or Turkish Worker visa, or;
  • have refugee status or humanitarian protection in the UK

What documents can you use to prove your relationship?

You will need to submit several documents to UKVI to prove your relationship. The evidence you send should be less than four years old, be from official or verifiable sources (such as the government, your doctor, your dentist, or a local authority), and must show that you are in a genuine relationship with your partner/spouse. The exact documents you need to provide will depend on your circumstances, and these will be explained to you by UKVI. Some items you may need to submit to the Home Office include your:

  • marriage certificate or civil partnership certificate
  • tenancy agreement, utility bills or council tax bills stating that you live at the same address or pay bills together
  • a bank statement from a joint bank account, or stating that you live at the same address
  • a letter from your doctor or dentist confirming that you live at the same address

If you are unsure if the documents you have collated are enough to prove your relationship, speak to an immigration Solicitor, who will be able to check and confirm this for you.

Do I need to prove that I live with my partner?

Paragraph GEN.1.2. Of Appendix FM to the Immigration Rules states that a partner is defined as “a person in a genuine and subsisting relationship to a person who is their spouse or civil partner, fiancé(e) or proposed civil partner, or a person who has been living together with the applicant in a relationship akin to a marriage or civil partnership for at least two years prior to the date of application”.

As such, the requirement to have lived together only applies to those who are not married or in a civil partnership.

How should I write a proof of relationship letter to the Home Office?

As part of your spouse or partner visa application, it is advisable to prepare and send a ‘proof of relationship letter’. This should be kept brief and to the point, and explain the circumstances of your relationship. Ideally, you should include:

  • a timeline of your relationship together
  • details of how and when you met
  • how your relationship developed
  • your plans to live together in the UK

It is also possible to ask a close family member or friend who know you well to write this letter. If so, they should include further details about how they know you (or your partner), when and how they first understood you were in a relationship and their belief that your relationship is genuine and will continue in the UK.

How do you prove a subsisting relationship is genuine?

In addition to the core documents outlined above and proof of relationship letter, we recommend submitting a portfolio of additional information which makes it 100% clear that your relationship is genuine. This may include photos, copies of instant message correspondence, texts, and letters that show when you met that your relationship developed over time, and you are still together. Again, if you are unsure if you have prepared enough information to back up your case, speak to an immigration Solicitor who will review and confirm this for you before it is submitted to UKVI.

What is Dependent Visa for USA?

Known to have one of the largest ethnic diversity, the USA attracts people for leisure, work, studies, and so on. Sometimes, when they are settled in the country, they would want to bring their spouse and children to live with them. The US Government has a provision for this too in the form of a US dependent Visa .

A Dependent Visa USA allows the spouse or children of certain US visa holders to accompany them to the country. Depending on the type of visa the individual possesses, the partner and the children can apply for a corresponding dependent permit. The validity of these visas varies upon the validity of the primary visa. If the sponsoring individual has a permit for say 2 years,  their dependents will have a visa valid for up to 2 years. Based on the type of primary visa, the dependent visas are of the following major types - 

  • H4 Dependent Visa - This permit is issued to the spouse/children of individuals working in the USA under the H1-B category. 
  • F2 Dependent Visa - This is issued for the spouse/children of people studying in the country on an F1 permit.
  • L2 Dependent Visa - Dependents of people on company transfer in the US under the L1 category are issued with this type of permit.
  • J2 Dependent Visa - Issued to the spouse/children of individuals on exchange programs under the J1 category.

Note:- Throughout this guide, the term ‘sponsor’ refers to the individual upon whom the dependent depends on. 

The F2, L2, J2, and H4 visa application , are all applied in a similar way. Before making the application, ensure that one is eligible for the particular type based on the permit of the guardian. The process can then be continued by following the below procedure - 

  • Collect all the documents required for the application. Each type of Dependent Visa USA has its own set of additional documents.
  • Create an account on the US CEAC ( Consular Electronic Application Center).
  • Fill in the NIV DS-160 form correctly. Please make a note of the barcode number on the form.
  • Proceed to pay the fees online. Keep the receipt number safe.
  • The next step involves making two appointments. The first one is for the biometric submission at a VAC. The second one is for the visa interview at the US Embassy or Consulate.
  • For the first appointment, visit the VAC with the passport, appointment confirmation page, and DS-160 confirmation page. The biometric details of the applicant will be taken here, and the form will be stamped for approval.
  • Visit the embassy or consulate with the passport, stamped DS-160 page, and the appointment confirmation page for the visa interview. The L2, F2, J2, H4 visa interview questions will be based on the purpose, intent, duration, as well as questions to determine the legitimacy of their marriage with the spouse. The applicant will have to prove to the consular officer that they are genuinely married and that they plan on staying in the US only for a temporary visa period.

It is recommended that the dependents apply for the visa at the same time as their sponsor applies. This will make it faster and easier for visa approval. It is necessary that all the forms including the H4 visa application forms are filled accurately, and submit the original documents. Any faults in the application may cause it being delayed, and fake or invalid documents will lead to a visa denial. A rejected visa can make one ineligible for future visa applications. 

Please note that individuals below the age of 14 and over the age of 80 do not have to attend a visa interview or a biometric. Also, if a person has had their dependent visa expire in the past 12 months and are applying for the same category, they are also exempt from the interview. However, in certain cases, you may be required to attend an interview or submit biometrics.

The individuals who can apply for US Dependent Visa have to fulfil the following criteria - 

  • They should be a legally married spouse of a valid H, F1, L1, J1 visa holder, or
  • They must be an unmarried child under the age of 21, of the same visa holder.
  • One must possess a valid passport for at least 6 months from the date of travel.
  • In certain categories such as F2, they must also be able to show sufficient financial funds.

The documents required for the application varies from type to type. Apart from the general documents, each type has additional requirements. The common documents for US dependent visa are as follows - 

  • A passport valid for at least 6 months from the date of travel
  • 2 Valid photographs
  • Photocopies of your passport pages
  • The DS-160 confirmation page
  • Interview confirmation letter
  • Fees payment receipts
  • Original marriage certificate, if you are the spouse, along with - 
  • Genuine marriage proof such as:
  • Wedding album
  • Wedding guest list
  • Receipts from the wedding
  • Receipts of any honeymoon trips
  • If married at a registrar office, wedding affidavit, and pictures of you and your spouse with the wedding witnesses.
  • Original birth certificate, if you are a child of the sponsor

Apart from these, the specific documents required for each category are as below - 

  • Photocopy of the sponsor’s H1-B type visa
  • Photocopy of sponsor’s I-129, I-797, and Labor Certification Application (LCA) forms
  • Copy of the sponsor’s letter of employment
  • If they are already working in the US, pay stubs and tax filing information
  • Copy of the sponsor’s passport
  • Your original I-20 form,
  • Copy of the F1 Visa holder’s I-20 form
  • Copy of F1 Visa
  • If applying separately, copy of sponsor’s passport
  • Proof of funds - Bank statements, tax records, passbook, payslips, etc
  • Photocopies of L1 Visa holder’s I-129, I-797 forms
  • Copy of the sponsor's passport, and visa
  • Letter from the employer of the sponsor, explaining the job description
  • Letter from the previous employer of the L1 holder
  • If applying separately, L1 holder’s payslips in the US.
  • Completed DS-2019 form
  • Copy of the sponsor’s DS-2019 form
  • If the J1 holder is an intern or trainee, a copy of their DS-7002 form
  • Proof of funds to cover expenses
  • Health insurance, if required

The general time of processing visa is in the range of 15-30 working days. Once the application has been submitted, your visa will be issued for validity as per the consular officer depending upon the interview, and the validity of your sponsor’s visa. The duration, however, can vary depending upon the decision of the Customs Border Patrol officers at the port of entry.

When you receive the visa, you are required to keep the following points in mind - 

  • Carry all the travel documents, along with the visa.
  • Ensure that you do not overextend the stay beyond the visa duration and validity.
  • If you are on an H4 dependent visa , you cannot work unless you are issued with an EAD ( Employment Authorization Document). This is applicable only if your spouse is on H1-B visa. If your spouse possesses other types of permit, you will not be allowed to work. You can, however, apply for a driving license, enrol in short term courses, and open a bank account.
  • If you are on an L2 Dependent Visa , you are eligible to work after you obtain your EAD, apply for driving license, open a bank account, get a social security number, as well as enrol in higher education courses. 
  • If you are on an F2 Dependent Visa , you are not permitted to work or take part in any credit or degree-bearing courses. You are allowed to take part in voluntary and unpaid work if required. You can also take part in recreational, hobby, and other non-degree-bearing courses. For children, they are allowed to be enrolled in school up until middle school. They are not allowed to do higher education while on an F2.
  • If you are on a J2 Dependent Visa , you are allowed to work once you get your EAD. you are also permitted to get a driving license and open a bank account. You can also apply for a social security number after you obtain the EAD.
  • Keep in mind that your Dependent Visa USA validity is up till the visa of your sponsor expires. 
  • Follow US laws and customs while you are in the country.

How can i extend my us dependent visa.

The possibility of an extension depends on the permit type, validity, and duration of the sponsor’s visa. If the sponsor has an extension or has a long duration permit, you may be able to extend the US permit. In order to do so, you must make an application to the USCIS (the United States Citizenship and Immigration Services) before your current visa expires. However, the success of your application will depend upon a variety of factors such as the intention, immigration status, and so on. Also, you will have to submit all the documents that you have submitted for the original visa. 

After Expiring My US Dependent Visa How Long Can I Stay?

After expiring your dependent permit, you cannot stay back any longer in the country. You must leave the country before the expiry. Staying back in the country after this permitted period is considered as an offence and can get you deported and in cases where there is a long period of stay after the expiry, you may even be banned from applying for a visa again. However, you may stay back in the country in the case where you have applied for an extension.

What is the Medical Test for US Dependent Visa?

The medical test requirements for the dependent permit depends on the duration of the stay. Since the duration again depends on the sponsor’s visa. Since the non-immigrant permits are for short duration stays, there are usually no medical test requirements necessary. However, it is advised that you get a medical checkup done before travelling to the US for your own safety.

Can I enrol for academic courses while I am on a dependent visa?

This depends on the exact type of dependent permit. The H4 and L2 dependent category permit you to take up studies in the US. However, once you are accepted by an institution, your category can be converted to an F1. The F2 dependent permit does not allow you to work in degree or credit-bearing courses. If your child is the F2 holder, they may only study elementary school and middle school. 

Can a parent travel as a dependent on a Dependent visa?

No, you cannot travel to the US if you are a parent of the US permit holder. Parents do not come under the category of a dependent. Dependents include only children or spouses of the US visa holder. If you do wish to bring in your parents into the country, you can apply for a B1/B2 visa for them. 

Do I need educational documents for a Dependent visa?

No, it is not necessary to provide educational documents or English proficiency test for the dependent visa. Since you are going to the country as a dependent of the primary visa holder, you do not need them. However, if you plan on studying or working in the US on these, you may need them as necessary.

No, it is not mandatory to apply for the dependent permit at the same time as the primary visa holder. You may apply for it at a later period of time separately. The following guide provides a summary of some of the most common US dependent visas, both immigrant and nonimmigrant, to help you and your US-bound or US-based loved one explore the options that might be available to you to accompany or follow to join them in the States. We look at the different types of visas for dependants, including how long these will last, what they will allow and who can apply. We also look at the procedure and processing times involved, although you may be able to visit friends and family without a visa.

What are the different types of US dependent visas?

There are two main types of US dependent visa: immigrant and nonimmigrant . An immigrant visa is for immediate family looking to settle in the States on a permanent basis, while a nonimmigrant visa is for those looking to travel to the US on a temporary basis, for example, to join or accompany your partner or parent who may be working or studying there.

In some cases, you may be able to apply for what is commonly known as a derivative visa, where you are seeking permission to come to the US on the basis of your immediate relationship with the principal visa applicant or primary visa-holder. As a temporary visa, a derivative visa falls within the nonimmigrant classification. This could be, for example, as the spouse or dependent child of an E1 treaty trader or an E2 treaty investor, or the spouse or child of an L1 intracompany transferee , specifically known as an L2 visa-holder.

In other cases, you may be applying for a nonimmigrant visa in your own right, such as a B2 visit visa , which is for the purpose of visiting friends and family in the States.

When it comes to immigrant US dependent visas, you will need to be sponsored by either a US citizen or, in some cases, a lawful permanent resident. This could include the IR1 spouse visa, the IR2 dependent child visa or the IR5 parent visa, as well as a range of family-preference immigrant visas. Other family-sponsored visas include the K1 fiancée or K3 spouse visa.

Spouses and children may also accompany or join employment-based immigrants under E1 to E5 immigrant classification, including: priority workers and persons of extraordinary ability (E1); professionals holding advanced degrees and persons of exceptional ability (E2); professionals, and skilled and unskilled workers (E3); certain special immigrants, such as broadcasters and ministers of religion (E4); and immigrant investors (E5).

What you can do under a US dependent visa?

The scope of a US dependent visa will depend on the type of visa sought. If you are granted an immigrant visa, you will be able to live, work and study in the US free from immigrations restrictions. In contrast, there are a various conditions of stay attached to nonimmigrant visas, from where you can or cannot work to what else you can or cannot do.

Each category of nonimmigrant visa has different requirements, with different restrictions, so you must ensure that you carefully consider what each visa will permit you to do during your stay in the States. In the case of the B2 visit visa, you will not be allowed to undertake paid employment, so you will not be able to earn any income during your stay. However, you will be able to take in the sights or travel about for the purposes of tourism. You will also be able to undertake a short course of recreational study to keep you entertained if your US host is busy.

In contrast, as an L2 spouse, or a spouse under E1 or E2 classification — and even though the primary visa-holder will be limited to working for the US business for which their visa was granted — there will generally be no restrictions on where you can work, provided you are able to provide proof of your status to your US employer. On the grant of a visa under either L or E classification, you will usually be considered employment-authorised incident to status. L2 and E1/E2 children can also undertake part-time or full-time study in the States.

How long does a US dependent visa last?

The length of a US dependent visa will depend on the type of visa sought, where the B2 visit visa is the most limited in duration, with a maximum initial stay of up to 6 months. At the opposite end of the spectrum are various different immigrant visas, providing the successful applicant with permanent residency status, with the derivative visa lying somewhere in-between, whose length of validity will be directly tied to that of the primary visa-holder. This means that spouse or children can apply at the same time and expect the same grant of leave.

Under a derivative visa, for example, if you are granted admission to the States under L2 nonimmigrant classification, you will typically be granted permission to stay for the same length of time as your L1 spouse or parent. An L1 intracompany transferee will usually have permission to work in the US for 3 years, unless they have applied on the basis of establishing a new US office, in which case their initial stay will be limited to 1 year. L1 visa-holders can also apply for an extension of stay in increments of 2 years, until they have reached the maximum limit of 5 years for L1B specialised knowledge employees or 7 years for L1A executives or managers. As an L2 visa-holder, your visa can be extended at the same time.

Equally, if you are granted a visa under E classification — as the spouse or dependent child of someone engaging in substantial trade in the US, or overseeing the running of a US business in which they have invested a substantial amount of capital, or as a senior or essential employee of the principal investor — the length of a derivative visa will again be directly tied to that of the primary visa-holder. Even though the initial grant of stay will be for 2 years, there is no limit to the number of extensions an E1 or E2 nonimmigrant may be granted, provided they maintain an intention to depart the States when their status expires.

Does a dependent visa lead to a US Green Card?

An immigrant visa, or green card, is specifically designed to allow the successful applicant to settle in the States on a permanent basis although, in some cases, a green card may initially be granted with conditional residency status. As a conditional permanent resident, you will be given a green card for 2 years. You can then apply to remove this conditional status within 90 days before the 2-year anniversary of your entry into the US.

Importantly, the K1 fiancée or K3 spouse visa are strictly nonimmigrant visas. However, they are treated under the category of immigrant visas because they are for immigration-related purposes, allowing the fiancée or spouse of a US citizen to live with them in the States while awaiting approval of an immigrant petition to adjust their status to permanent residency. The K1 visa will allow you to live with your new spouse, provided you marry within 90 days of arriving in the US, while the K3 visa is designed to shorten the physical separation between you and an existing spouse, both pending the grant of permanent resident status.

Other nonimmigrant visas may also provide a path to permanent residency. For example, the L1 and L2 visas are ‘dual intent’ visas, allowing you and your spouse or parent to temporarily live in the US with the possible intention of permanently immigrating to the States. This means that you, at the same time as your spouse or parent, can eventually apply for a green card, provided you meet the qualifying requirements for permanent residency status.

US dependent visa eligibility requirements

To be eligible for a US dependent visa, you will typically need to satisfy a strict relationship requirement. In most cases, this means that you must be either the spouse or unmarried child under the age of 21 of the principal applicant or primary visa-holder, or a qualifying relative of either a US citizen or lawful permanent resident. However, US visa law does not recognise common-law relationships, where you will not be eligible for derivative visa status as a partner or fiancée. There is also no derivative visa status for the spouse or dependent children who wish to accompany or join the holder of either a B, C, D or Q nonimmigrant visa.

In circumstances where you do not qualify for derivative status, you will need to apply for a work or study visa in your own right, or if the primary purpose in travelling to the States is to accompany the principal visa-holder, for a visit visa. A visit visa can be granted, regardless of proximity of relationship. This means that you can apply for a visit visa to travel to stay with an immediate relative for up to 6 months, or even a distant relative or old school friend, provided you can show that you meet the relevant requirements. This will include having sufficient funds to cover the cost of your trip and an intention to leave at the end of your stay.

How do you apply for a US dependent visa?

Where sponsorship is required from a US citizen or lawful permanent resident, you must first have in place an approved petition from US Citizenship and Immigration Services (USCIS), before filing an online visa application with your local US Embassy or Consulate using Form DS-260, and scheduling and attending an in-person interview. When filing for a nonimmigrant derivative visa or visit visa, you will instead need to file Form DS-160 and attend an interview.

You will also need to file a number of detailed documents in support, proving that you meet the relevant requirements for your visa. The nature of this documentation will vary, depending on the classification of visa sought, although you will almost always need to prove that you have a qualifying relationship with either your US sponsor, or the principal applicant or primary visa-holder, unless you are applying for a visit visa in your own right. However, even when applying for a B2 visit visa, you may still be required to satisfy the consular officer dealing with your application that the purpose of your trip is to spend time with a loved one.

Processing times for immigrant and nonimmigrant visas can vary a lot, from anything between a matter of days and weeks, to months or even years. Visa processing times can also vary from country to country, so enquiries should be made with your local Embassy or Consulate. Their website should also set out the relevant fees. However, it is important not to make any firm travel plans until you have been approved for, and have received, your US dependent visa.

Visiting the US

If you are visiting someone in the US and do not plan to stay to work or reside there, you can travel as a visitor. Under the visitor rules, you could be eligible to travel visa-free or you will need to apply for a visitor visa.

If you are a national of one of several participating countries, and meet the other qualifying requirements, you may be able to travel to the States visa-free under the Visa Waiver Program (VWP) . However, to qualify for a visa waiver under the VWP, you must:

  • be a national of an eligible country (you can check to see if your country participates in the VWP on the US department for Homeland Security website)
  • have a valid e-passport and hold a return or onward ticket
  • not be ineligible to receive a visa under US immigration law
  • be planning to travel to the US to visit your loved one for less than 90 days.

If you are eligible for visa-free travel, you will need to obtain travel authorization under the Electronic System for Travel Authorisation (ESTA) prior to boarding a US bound air or sea carrier at least 72 hours before you depart. ESTA authorisation will usually last for up to 2 years, where you can make an unlimited number of trips to the US within this time, with each stay lasting up to 90 consecutive days, provided you are not making the US your home through frequent or successive trips. If you do not qualify for visa-free travel under the VWP, or if any application for ESTA authorisation has been denied, you will instead need to apply for a visa.

Skilled Worker visa

Your partner and children.

Your partner and children can also apply to join you or stay in the UK as your ‘dependants’ if they’re eligible. They’ll need to complete separate applications.

If your partner or child’s application is successful, their visa will usually end on the same date as yours. If a child’s parents have visas with different expiry dates, the child’s visa will end on the earlier date.

A dependant partner or child is any of the following:

  • your husband, wife, civil partner or unmarried partner
  • your child under 18 - including if they were born in the UK during your stay
  • your child over 18 if they currently have permission (‘leave to enter’ or ‘leave to remain’) to be in the UK as your dependant

You’ll need to provide evidence of your relationship to your dependant when you apply.

If you’re the first person in your family to apply, you can get a ‘family linking code’ to connect your applications together. Your family members can enter the same code when they apply.

If you’re a care worker or senior care worker

Your partner and children cannot apply to join you or stay in the UK as your dependants unless you were employed as a care worker or senior care worker in the UK and on a Skilled Worker visa before 11 March 2024 and one of the following is true:

you’re currently still on a Skilled Worker visa

you’re extending your Skilled Worker visa with your current employer

you’re changing to a new job within the same occupation code while on a Skilled Worker visa

Your partner

You must be able to prove one of the following:

  • you’re in a civil partnership or marriage that’s recognised in the UK
  • you’ve been living together in a relationship for at least 2 years when you apply
  • you’ve been in a relationship for at least 2 years when you apply but you cannot live together, for example because you’re working or studying in different places, or it’s not accepted in your culture

If you’re not living together, you’ll need to prove that you have an ongoing commitment to each other, for example by providing evidence that you:

  • communicate regularly with each other
  • support each other financially
  • care for any children you have together
  • spend time together as a couple, for example on holiday or at events
  • live with you, unless they’re living away from home in full-time education - for example, at boarding school or university
  • not be married or in a civil partnership

You’ll need to provide evidence of their address, such as:

  • a bank statement
  • credit card bills
  • driving licence
  • NHS registration document
  • an official letter from their university or college

Money they need to support themselves

Your partner and children must have a certain amount of money available to support themselves while they’re in the UK.

You - or your partner or child - will need:

  • £285 for your partner
  • £315 for one child
  • £200 for each additional child

You - or your partner or child - would need to have £600 to bring your partner and one child with you to the UK (£285 for your partner and £315 for your child).

You would also need to have £1,270 available to support yourself for your own application.

You - or your partner or child - will need to have had the money available for at least 28 days in a row. Day 28 must be within 31 days of you or them applying for this visa.

You’ll usually need to show proof of this when they apply , unless either:

  • you have all been in the UK with a valid visa for at least 12 months
  • your employer can cover your family’s costs during your first month in the UK - this must be confirmed on your certificate of sponsorship

If your partner or child is applying at a different time to you, they’ll only need to prove they have enough money to support themselves if they have been in the UK for less than 1 year.

Apply from outside the UK

Your partner and children must either:

  • apply online as your partner outside the UK

apply online as your child outside the UK

Each family member will need to complete a separate application and pay the visa fee . They must apply before they travel to the UK.

They’ll need your application number - you’ll get this when you apply. This number is called a Global Web Form (GWF) or a Unique Application Number (UAN). You’ll find it on emails and letters from the Home Office about your application.

They can also enter a ‘family linking code’ if you got one when you applied. This will connect your applications.

Proving their identity

As part of an application, your partner and children will need to prove their identity.

They’ll either:

  • have their fingerprints and photograph taken at a visa application centre - this is to get a biometric residence permit
  • use the ‘UK Immigration: ID Check’ app to scan their identity document - they’ll also create or sign in to their UK Visas and Immigration (UKVI) account

They’ll be told what they need to do when they apply.

If they do need an appointment:

  • the visa application centre may need to keep their passport and documents while they process their application
  • they may have to travel to get to their nearest centre (this could be in another country)

How long it takes to get a decision

Once they’ve applied online, proved their identity and provided their documents, they’ll usually get a decision within 3 weeks.

They may be able to pay to get a faster decision - they’ll be told if they can when they apply.

Apply from inside the UK (extend or switch their visa)

If you extend or switch your visa, your partner or child’s current visa will still be valid until its original end date. Your partner or child need to apply to extend or switch their visa, either:

  • at the same time as you
  • at any time before their current visa expires

This includes children who have turned 18 during your stay.

Your partner or children cannot apply to switch to your Skilled Worker visa as your dependants if they are currently in the UK:

  • on a visit visa
  • on a short-term student visa
  • on a Parent of a Child Student visa
  • on a seasonal worker visa
  • on a domestic worker in a private household visa
  • on immigration bail
  • because they were given permission to stay outside the immigration rules , for example on compassionate grounds

If your partner or child is currently in the UK on a Student visa, they can only switch if they have either:

  • completed the course they were sponsored to study
  • studied for a PhD for at least 24 months

Your partner and children cannot apply to join you or stay as your dependants if you switch to a Skilled Worker visa from another visa. 

They can only apply to join you or stay if you were employed as a care worker or senior care worker in the UK and on a Skilled Worker visa before 11 March 2024 and one of the following is true:

The application form will tell you if you can include your partner and children in your application or whether they need to apply separately.

If your partner or child apply separately, they’ll need to either:

apply online as your partner inside the UK

apply online as your child inside the UK

As part of their application, your partner and children will need to prove their identity. They’ll either:

  • have their fingerprints and photograph taken at a UK Visa and Citizenship Application Services ( UKVCAS ) service point - this is to get a biometric residence permit

They must not travel outside of the UK, Ireland, the Channel Islands or the Isle of Man until they get a decision. Their application will be withdrawn if they do.

Once they’ve applied online, proved their identity and provided their documents, they’ll usually get a decision within 8 weeks.

Children born in the UK

If you have a child while you’re in the UK, they do not automatically become a British citizen .

You must apply for your child’s dependant visa if you want to travel in and out of the UK with them.

The form you fill in depends on whether your child is inside or outside the UK. Your child must either:

You’ll need to provide a full UK birth certificate for each child, showing the names of both parents.

You must apply for their dependant visa before they turn 18 if they want to stay in the UK.

What your partner or child can and cannot do

Your partner or child can:

  • work, except as a sportsperson or coach
  • travel abroad and return to the UK
  • apply to settle permanently in the UK (also known as ‘indefinite leave to remain’) if they’ve lived in the UK for 5 years and meet the other eligibility requirements

They cannot apply for most benefits (public funds), or the State Pension.

If their application is successful, they’ll get a full list of what they can and cannot do.

Spousal sponsorship applications are thoroughly assessed by immigration officers to determine the genuineness of the applicants’ relationship. Typically, applicants must include letters of support and/or personal statements to demonstrate to the immigration officer that their relationship is authentic.

We often receive questions from our clients about the proof of relationship letters. Clients want to know what their friends and family should include in the letters to indicate that the couple’s relationship is genuine.

There are a few key points we suggest that friends and family members of the couple include in a relationship support letter:

Your relationship to the couple

A description of how the relationship started and how you became aware of the relationship

A statement that, in your judgement, the couple is in a real, ongoing, genuine relationship based on your experience and knowledge

Your contact information in case the immigration officer requires further information

It’s important to remember that immigration officers are searching for any indication that the marriage is one of convenience or one that is forced. To demonstrate that the marriage is authentic and not a legal union for the purpose of immigration, you should show that there is a rich history in the relationship and that the couple has been gradually building a life together.

Immigration, Refugees and Citizenship Canada (IRCC) does not list the letter of support as a requirement in the document checklist . However, it’s important to note that the onus is on the applicant to prove their case. We almost always recommend that applicants submit a letter of support with their application to help strengthen their case and increase their odds of success.

Let us go through the paragraphs as stated below to understand the structure of the statement of purpose. Please note that the below-mentioned structure is not the only way to write your SOP. It is only indicative of how a well-written SOP should be structured.

3. Introduction

This should be the starting paragraph, but it is not to be confused with a self-introduction. 4. Academic Background and details

This is the second paragraph that should summarize your academic background, qualifications, and accolades (if any). It also elaborates on what you have done so far, what you are currently pursuing,

academic strengths, projects done, or any industrial training exposure. If your grades are not that impressive, fret not. Please make sure that you do not particularly highlight any negative aspects in your SOP, without being dishonest in your approach. Do take note that you have to put across your point subtly and give them the necessary details emphasizing the noteworthy aspects of your academics.

5. Professional Experience

The third paragraph comprises your professional experiences. That is if you have any professional experience it should be discussed in the upcoming paragraphs. This helps in establishing your career progression. An impressive career graph is also a great plus point and would add to your positives.

6. Reasons why you choose this particular Course

In the fourth paragraph, you need to list out the reasons for opting for the particular academic course in question.   In this paragraph, you should elaborate on the reasons for wanting to join the desired specific course and the different modules that you would be covering during this course. You should also discuss the skills you would be acquiring as a result of the course along with the exposure you would gain in this duration that would help in developing and honing the skills that are required to achieve your professional goals.

7. Career Goals and aspirations

This is the most important paragraph and should be the highlight of your SOP. Here you should elaborate on your near-future short-term goals as well as your long-term plans. 

Short-term goal: This mentions your immediate goal of where and what kind of a company you would want to work with right after you graduate from the course post-completion. Do remember to name some good MNCs with a global presence to not limit yourself geographically. Also, make a mention of the designation at which you see yourself working. Simply put, this paragraph should give a brief about the kind of job profile that you aspire to have in your near future.

Long-term plans: This is where you discuss your dream goals and aspirations like where do you see yourself in 10-15 years from the present. Although your plans may change later, you have to give an honest view about what you currently aspire to be or do. Say, for example, you may see yourself working at the top management level of a big multinational corporation or maybe you want to be an entrepreneur and are working towards starting and expanding your own business. You may be planning on contributing to expanding your family business to a global level or you may want to study further, maybe get a doctorate, or even want to become a professor or a researcher.

Whatever your plans may be, it is advisable to briefly discuss your professional goals, principles and core values. But please note that it should not just be about you. You need to ensure that you also mention how you would be able to create a difference while treading on your journey. It is important to be able to portray how you would also influence young aspirants within the industry considering the current industrial and economic scenarios and also guide them to achieve their goals and become better global citizens of tomorrow.

  8. Reasons why you opted for this University

In paragraph number six, you should try and convince the specific University about your suitability of candidature. You should discuss the benefits of the knowledgeable faculty, the course curriculum, research and fieldwork, internship opportunities as well as other activities that are specific to the university. Also, make sure that you mention how all of these things would contribute to enhancing your profile as well as how you would be the right fit for their college and how you could make a contribution to them.  

9. Closing Paragraph of SOP

In this paragraph of your statement of purpose for visa application, you should conclude by stating your passion, willingness, and readiness to pursue your desired course at the college of your choice. You need to ensure that you sound focused on your vision for the future and emphasize your seriousness to follow your dreams. Also, do make sure that you mention your preparedness to face and overcome the challenges that come your way. This para should reflect your zeal and zest to work hard and succeed with the help of your course and your college and also how willing you are to make a difference to your specific industry and the world at large on a global platform.

Is there a difference between a Statement of Purpose same as a Personal Statement?

A personal statement seems to be quite similar to a statement of purpose, except for a few aspects. An SOP would ideally include a two-page essay about your goals, motivation, experience, extracurricular activities, achievements, and so on. A personal statement on the other hand is a crisp, one-page essay about your experiences, motivation, achievements, and so on. A personal statement is usually more personal than an SOP. So a personal statement should be more elaborate about your goals and aspirations. Whereas an SOP is a much more detailed form of a personal statement.

How to write a great SOP?

Here are the three major steps that need to be kept in mind while writing your SOP:

  • Plan your SOP well- The first and foremost thing to be done is to plan your SOP by outlining a structure and accordingly work towards constructing the SOP. A good way to build your introductory paragraph is by quoting an anecdote that piqued your interest in your chosen field. List down relevant pointers and create a step-by-step framework for each paragraph, then elaborate on each of the points mentioned systematically and creatively. Also, most importantly, emphasize your reason for choosing the course and the university.
  • Prepare a draft- Before moving on further, ensure that you create a draft and then re-draft your SOP to eliminate errors. Please note that when you also share your learnings from your professional experiences, it shows that you are a keen learner, which is a positive point. Ensure to use active voice when writing your SOP. Try and limit the use of technical terms and jargon. The introduction and conclusion of your SOP need to be clear and concise that communicates your vision. One point to remember, your SOP should always be written in reverse chronological order.
  • Review before you send your final SOP submission- It’s always important to review your work before final submission. Reviewing and re-analyzing your work will help to rectify any flaws in the order, flow, grammar, vocabulary, long sentences, punctuation, sentence construction errors, and other errors and issues. Please ensure that your SOP is proofread, verified, and double-checked properly before submission. If possible, try and get a second opinion, maybe from your professor, a senior, or a counsellor.

  • Please DO NOT COPY the content available on the internet and paste it into your SOP.
  • Please ensure that your SOP is not too long and limit the number of words to 1000-1500 maximum.

  • Please do not cook up stories in your SOP. Ensure that everything you mention is authentic and believable. Your honesty will go a long way.

  • You are narrating your story through your SOP so write sentences in the first person and not in the second/third person.

  • The use of informal language or slang in your SOP. Ensure that you write your SOP in a formal, professional language.
  • Exceeding the word limit by getting carried away with your story and writing irrelevant information will result in creating a negative impression. Keep it professional.
  • Submission without proofreading your SOP. Reverification and double-checking are very important.

Writing an effective and impactful Statement of Purpose for visa application requires a lot of time, effort, and thought. However, it also depends upon the way you do your research and homework. It is also quite subjective and the time taken to write the SOP may vary from person to person.  But the important thing is that you do not make the mistake of taking it too lightly. This is not like your regular college assignment. A well-written SOP can make or break your dream of studying abroad. And remember, nobody is perfect. Sometimes, it’s a swing and a miss. Yet, you have no reason to give up hope. If your application gets rejected for some reason, you can always try again and this time, do it even better.

The GTE requirements for Australian student visas have now been changed to the GS (Genuine Student) regulations. This applies to visa applications on/after 23rd March 2024.
